Abstract: | A relevância da tributação na escolha da localização física do investimento, apesar de não ser o
único fator determinante (ou o mais relevante em muitos casos), tem sido apontado como sendo,
por vezes, um importante fator de desempate, em virtude de a tributação afetar sempre a
rentabilidade líquida de qualquer investimento. Assim, é importante analisar sob o ponto de vista
fiscal a tributação das sociedades não residentes. Nesta dissertação, os principais objetivos
consistem em analisar os aspetos fiscais mais importantes associados à tributação das referidas
sociedades, em particular os problemas relativos ao fenómeno da dupla tributação, análise do
conceito de estabelecimento estável e as formalidades legais associadas a esta problemática.
Em termos metodológicos, esta dissertação segue uma perspetiva hermenêutica, analisando-se
o contexto social e legal envolvente, assim como a literatura, jurisprudência e legislação
existente relativa à tributação das sociedades não residentes. Em termos globais, constata-se
que os acordos de dupla tributação são fundamentais para evitar ou atenuar a dupla tributação
internacional dos rendimentos. O conceito de estabelecimento estável desempenha um papel
relevante no âmbito da tributação das sociedades não residentes, equiparando em termos de
tratamento fiscal as sociedades não residentes com estabelecimento estável às sociedades
residentes. Constata-se igualmente que as formalidades administrativas sofrem de algumas
lacunas e deverão ser melhoradas, no sentido de as tornar mais claras e tornar menos onerosos
os custos de cumprimento da legislação associada. The importance of taxation when selecting the place where to invest, though not being the sole determinant element, (or the more relevant in most cases), has been regarded as a key factor of decision, since taxation has always an impact on the revenue of any investment. Thus, it is important to analyze from the point of view of taxation the case of non-resident companies. In this dissertation, the main objectives are to analyze the main aspects related to fiscal taxation of nonresidents, particularly the problems related to the phenomenon of double taxation, analysis of the concept of permanent establishment and the legal formalities related to this issue. In terms of methodology, this dissertation follows a hermeneutic perspective, analyzing the social and legal environment, as well as literature, case law and existing legislation concerning the taxation of non-resident companies. Over all, it appears that the double taxation agreements are essential to prevent or mitigate the double taxation of income. The concept of permanent establishment plays a relevant role in the taxation of non-resident companies, equating in terms of tax treatment of non-resident companies with permanent establishment to resident companies. It also follows that bureaucracy suffer from some shortcomings and should be improved in order to make them clearer and make less burdensome compliance costs associated with the legislation. |
